Car Accident; hit from behind I was hit from behind and smashed into another truck. My truck was totalled and my insurance company says the value of the truck won't cover the loan i owe. Also, now i don't have a vehicle and don't have good credit and surely can't buy anything. I also hurt myself and have been to the emergency room, where i found out i'm going to have future problems with a nerve in my spine that burns in my back and down my leg. My questions are: Can I get the other insurance company of the person that hit me to cover the balance of my loan; can i get the other insurance company to provide me with a rental car indifintly until i can somehow find another car; and what about the medical problems and now incredible stress and anxiety i'm going through, will the other insurance company help me through all this? Do i need to get a lawyer??? |

You can certainly get a lawyer to help you sort everything out. You won't be the first or the last person to do so. If you were at fault, according to the police and insurance investigators, you likely will not be able to sue the other person's insurance company and your insurance will have to suffice.
If you were not at fault, as determined by the police and insurance investigators, then the person who was at fault is financially responsible (in most states). Their insurance should cover your costs.
It will largely depend on where you live and who is responsible for the accident, and whether or not you have a case. If you can't determine this on your own, then you may want to consult with a lawyer.
I would also recommend getting GAP coverage in the future. It wil cover the difference between how much you owe on the car and what the car is worth in case of a future loss.
